1. Acceptance of Terms
By accessing or using Aviunion (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Definitions
- "Aviunion," "we," "us," or "our" means the operator of the Service.
- "User" or "you" means any individual or entity that accesses or uses the Service.
- "Providers" means third-party airlines, travel agencies, aggregators, data partners, or other service providers whose products, data, or services are referenced by the Service.
3. Eligibility; Accounts
- You must be at least the age of majority in your jurisdiction (and in any event at least 18) to use the Service.
- If you create an account, you agree to provide accurate, current, and complete information and maintain the security of your credentials.
- You are responsible for all activities that occur under your account, including tracked searches, saved trips, search history, and notification preferences associated with it.
- We may suspend or terminate your account, or disable account-linked features, if we reasonably believe you have violated these Terms, misused the Service, or created risk for Aviunion, our providers, or other users.
4. The Service
Aviunion is a flight search and comparison platform that helps users compare trip options, coordinate travel, and monitor price movement over time. The Service may provide:
- Multi-origin search and destination-comparison tools
- Calendar-based fare search and date-comparison tools
- Account features such as saved trips, tracked searches, and search history
- Product updates, roadmap information, and feedback tools
- Links or handoffs to third-party booking Providers
We are not a travel agency and do not sell tickets, provide transportation, or enter into contracts of carriage. All bookings, payments, and travel services are provided by Providers under their own terms and policies.
5. Fees and Payments
- Aviunion does not charge Users for basic search functionality. Any payments for travel services are made directly to Providers, and additional fees, taxes, surcharges, and restrictions may apply per Provider policies.
- You are responsible for reviewing all Provider terms (including fare rules, baggage fees, change/cancellation policies) before completing any booking.
6. User Conduct; Prohibited Uses
You agree not to, and will not permit others to:
- Use the Service in violation of any law, regulation, or third-party right
- Access or scrape the Service using bots, spiders, or automated means without our prior written consent
- Probe, scan, or test system or network vulnerabilities or circumvent security or authentication measures
- Interfere with or disrupt the operation of the Service or any related servers or networks
- Reverse engineer, decompile, disassemble, or derive source code from the Service (except to the extent such restriction is prohibited by law)
- Use the Service to build or train competing products or services
- Upload or transmit any malware, harmful code, or content that is unlawful, defamatory, or infringing
7. Third-Party Services and Links
The Service may display information from or link to Providers or other third-party sites. We do not control and are not responsible for third-party services, content, or policies. Your interactions with Providers are solely between you and the applicable third party. We use third-party analytics services, including Google Analytics, to improve the Service and understand usage patterns.
8. Flight Information and Availability
- Flight data is provided by third-party sources and is subject to change at any time without notice.
- We do not guarantee the accuracy, completeness, availability, pricing, schedules, or any other aspect of flight information.
- Actual prices, availability, terms, and conditions are determined by Providers at the time of booking.
9. Intellectual Property; Feedback
- The Service and all content, features, and functionality (including text, graphics, logos, user interfaces, and software) are owned by Aviunion or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works.
- You may choose to submit comments, ideas, or suggestions ("Feedback"). You grant Aviunion a perpetual, irrevocable, royalty-free, worldwide license to use the Feedback for any purpose without restriction or attribution.
10. User Content
If you submit or upload content to the Service, you retain ownership of such content. You grant Aviunion a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content for the purpose of operating and improving the Service. You represent and warrant that you have all rights necessary to grant this license and that your content does not violate any law or third-party rights.
11. Disclaimers; Beta Features
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be accurate, current, or reliable.
- Some features may be identified as alpha, beta, or experimental and may be subject to additional terms, limited availability, rate limits, or discontinuation at any time.
- Tracked searches, price alerts, digest emails, and other account-linked monitoring features may be delayed, incomplete, unavailable for some routes, or changed as we refine the beta experience.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AVIUNION OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY PROVIDER SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS (IF ANY) YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Aviunion and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any law or third-party right.
14. Term; Suspension; Termination
These Terms remain in effect until terminated. We may suspend or terminate the Service or your access to it at any time, with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service will cease immediately.
15. Changes to the Service and Terms
We may modify the Service and these Terms from time to time. Material changes to the Terms will be posted to the Service or otherwise communicated to you. Your continued use after changes become effective constitutes acceptance of the revised Terms.
16. Compliance; Export and Sanctions
You represent that you are not located in, under the control of, or a national or resident of any country or region subject to embargo or comprehensive sanctions by the United States or other applicable jurisdictions. You agree to comply with all applicable export control and sanctions laws.
17. Electronic Communications; Notices
You consent to receive communications from us electronically. We may provide notices by posting to the Service or by email to the address associated with your account (if any). These communications may include service messages, security notices, account-related notices, and tracked-search emails you have elected to receive. Notices are deemed given when sent or posted.
18. Governing Law; Venue
These Terms will be governed by and construed in accordance with the laws of the United States, without regard to its conflict of laws rules. The courts located in the United States will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there. If you are a consumer resident in the EU/UK or another jurisdiction that grants you mandatory consumer protections or venue rights, this clause does not deprive you of those rights.
19. Miscellaneous
- Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
- Entire Agreement: These Terms constitute the entire agreement between you and Aviunion regarding the Service and supersede prior or contemporaneous agreements on the subject matter.
- Force Majeure: We will not be liable for any delay or failure due to causes beyond our reasonable control.
